In 2005, John Tiffany executed a promissory note and mortgage for the
purchase of a home for $120,000, and the note and mortgage were subsequently
assigned to the Bank. In October 2008, the Simses entered into a land contract
to purchase the residence from Tiffany, and the contract required a down
payment and monthly payments for a total purchase price of $185,000. The
Simses paid the down payment and began to make monthly payments, but
Tiffany stopped making the mortgage payments.
