Especially Kidz is a licensed health care facility (“the facility”) located in
Indiana. The facility provides long-term medical care to children who suffer
from chronic diseases.
Before delving into the underlying facts of this case, we briefly note some of the
relevant federal regulations that apply to the facility. Specifically, 42 C.F.R. §
483.1 provides that the provisions of this part “contain the requirements that an
institution must meet in order to qualify to participate” as a facility in the
Medicare and Medicaid programs.
