The profile clearly provided that Summer was thirteen years old and included a photograph of an individual who looked thirteen years old. Unbeknownst to Koch, the Facebook profile for 1 IND. CODE § 35-42-4-6. The jury also convicted Koch of Class A misdemeanor resisting law enforcement. However, he does not appeal that conviction or sentence. Summer was not for an actual person.
