Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. SHORT TITLE. This Act may be cited as the ``Honoring Our Nation's Own Retired Servicemembers Act'' or the ``HONORS Act''. SEC. 2. HONORS DETAIL FOR THE FUNERAL OF A VETERAN: REQUIRED MEMBERS MAY BE RETIRED. Section 1491(b) of title 10, United States Code, is amended-- (1) in paragraph (2), in the first sentence, by inserting ``, subject to paragraph (4)'' after ``other than members in a retired status''; and (2) by adding at the end the following new paragraph: ``(4) The two members described in the first sentence of paragraph (2) may, with the consent of the family of the veteran, be members in a retired status if the Secretary concerned determines that-- ``(A) no member who is not in a retired status is available within 50 miles of the location of the funeral; or ``(B) use of members in a retired status is fiscally necessary.''. <all>
