Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. SHORT TITLE. This Act may be cited as the ``Fair and Efficient Regulatory Commonsense Act''. SEC. 2. PUBLIC PARTICIPATION DIVISION. (a) In General.--Section 319 of the Federal Power Act (16 U.S.C. 825q-1) is amended to read as follows: ``SEC. 319. PUBLIC PARTICIPATION DIVISION. ``(a) In General.--There shall be a division within the Office, to be known as the Public Participation Division, administered by a Director appointed by the Director of the Office. ``(b) Rate of Pay.-- ``(1) Director.--The Director shall be compensated at an equivalent rate of basic pay prescribed for a director in the Office. ``(2) Employees.--The Director may appoint, and assign the duties of, employees of such Division, and, with the concurrence of the Office, fix the compensation of such employees and procure temporary and intermittent services to the same extent as is a
