Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. SHORT TITLE. This Act may be cited as the ``Ensuring the Necessary Destruction of Illicit Chinese Tobacco Act'' or the ``END Illicit Chinese Tobacco Act''. SEC. 2. DESTRUCTION OF ADULTERATED, MISBRANDED, OR COUNTERFEIT TOBACCO PRODUCTS OFFERED FOR IMPORT. (a) In General.--Section 801(a) of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 381(a)) is amended-- (1) in the fourth sentence, by striking ``or counterfeit device'' and inserting ``, counterfeit device, or counterfeit tobacco product (as defined in section 900)''; and (2) by striking ``drug or device'' each place it appears in the seventh, eighth, ninth, and tenth sentences and inserting ``drug, device, or tobacco product''. (b) Applicability.--The amendments made by subsection (a) shall apply beginning on the date of enactment of this Act. <all>
