Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. SHORT TITLE. This Act may be cited as the ``Defense Community Infrastructure Program Tribal Eligibility Act of 2026''. SEC. 2. INCLUDING TRIBAL GOVERNMENTS IN THE DEFENSE COMMUNITY INFRASTRUCTURE PROGRAM. Section 2391 of title 10, United States Code, is amended-- (1) in subsection (d)-- (A) in paragraph (1)(A), by inserting ``Indian tribes,'' after ``local governments,''; and (B) in paragraph (2)(B), by striking ``or local government'' each place such term appears and inserting ``government, local government, or Indian tribe''; and (2) in subsection (e)-- (A) in paragraph (4)(A)(ii)(I), by striking ``or local government'' and inserting ``government, local government, or Indian tribe''; and (B) by adding at the end the following new paragraph: ``(7) The term `Indian tribe' has the meaning given that term in section 4 of the Indian Self-Determination and Education Assistance Act (25 U.S.C. 5304).''. <all>
