Prescription Drug Transparency and Affordability Act

R. 2450 To amend the Public Health Service Act, the Employee Retirement Income Security Act of 1974, and the Internal Revenue Code of 1984 to increase oversight of pharmacy benefit management services, and for other purposes. _______________________________________________________________________ IN THE HOUSE OF REPRESENTATIVES March 27, 2025 Ms. McDonald Rivet (for herself, Mr. Carter of Georgia, Mr. Menendez, and Mr. James) introduced the following bill; which was referred to the Committee on Energy and Commerce, and in addition to the Committees on Education and Workforce, and Ways and Means, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned _______________________________________________________________________ A BILL To amend the Public Health Service Act, the Employee Retirement Income Security Act of 1974, and the Internal Revenue Code of 1984 to increase oversight of pharmacy benefit management services, and for other purposes. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. SHORT TITLE. This Act may be cited as the ``Prescription Drug Transparency and Affordability Act''. SEC. 2. OVERSIGHT OF PHARMACY BENEFIT MANAGEMENT SERVICES. (a) Public Health Service Act.--Title XXVII of the Public Health Service Act (42 U.S.C. 300gg et seq.) is amended-- (1) in part D (42 U.S.C. 300gg-111 et seq.), by adding at the end the following new section: ``SEC. 2799A-11. OVERSIGHT OF ENTITIES THAT PROVIDE PHARMACY BENEFIT MANAGEMENT SERVICES. ``(a) In General.--For plan years beginning on or after the date that is 30 months after the date of enactment of this section (referred to in this subsection and subsection (b) as the `effective
