Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. SHORT TITLE. This Act may be cited as the ``CBP SPACE Act''. SEC. 2. AUTHORITY TO ADJUST THE RATE OF MERCHANDISE PROCESSING FEES TO OFFSET THE CAPITAL COSTS INCURRED BY U.S. CUSTOMS AND BORDER PROTECTION; MODIFICATION TO DISPOSITION OF CUSTOMS USER FEES. (a) In General.--Section 13031 of the Consolidated Omnibus Budget Reconciliation Act of 1985 (19 U.S.C. 58c) is amended-- (1) in subsection (a)(9)(B)(i), by striking ``salaries and expenses'' and inserting ``salaries, expenses, and capital costs''; and (2) in subsection (f)(3)(A)(i)-- (A) in subclause (IV), by striking ``, and'' at the end; (B) in subclause (V), by striking the comma at the end and inserting ``, and''; and (C) by adding at the end the following: ``(VI) paying capital costs associated with passenger inspection services,''.
