Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. SHORT TITLE. This Act may be cited as the ``Safe Flights for Passengers and Flight Crews Act''. SEC. 2. ON-DEMAND ELIGIBILITY. (a) Requirement.--Notwithstanding any other provision of law and beginning 90 days after the date of enactment of this Act, any passenger-carrying scheduled charter operation shall be regulated by the Administrator of the Federal Aviation Administration as a domestic operation or a flag operation, as the case may be, under part 121 of title 14, Code of Federal Regulations, when operating an aircraft having a passenger-seat configuration of more than 9 passenger seats, excluding each crewmember seat. (b) Effect of Rulemaking.--The requirements of subsection (a) shall take effect 90 days after the date of enactment of this Act, regardless of whether the Administrator of the Federal Aviation Administration has issued
