Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. SHORT TITLE. This Act may be cited as the ``Snap Delivery Modernization Act of 2025''. SEC. 2. AMENDMENTS. The Food and Nutrition Act of 2008 (7 U.S.C. 2011 et seq.) is amended-- (1) in section 3 by adding the following definition-- ``(X) `Delivery platform or delivery services provider' means an entity that-- ``(1) facilitates the online-sale, or delivery, or both, of food from a retail food store; or ``(2) delivers food purchased from a retail food store, including using a first-party delivery service or contracting with a third-party to complete delivery.''. (2) in section 3(o)(5)-- (A) in subparagraph (B)-- (i) by striking ``order--'' and all that follows through ``(i)'', and (ii) by striking clause (ii), and (B) in subparagraph (C) by inserting ``(excluding related fees for delivery of the food)'' before the period at the end, and (3) in section 7(k)-- (A) in subparagraph (2)(B)-- (i) by striking ``delivery,'', and (ii) by inserting ``(excluding delivery fe
